Private server and royalties

I have a VPS located in Germany, which is running shoutcast and I want to stream copyrighted songs to it from the U.S. I want to keep my server private and not list it in the Shoutcast radio directory.

However, I'm going to place a flash player on my website. Which will be accessible from anyone.

I'm not expecting to have more than 10 listeners at a time and I'm not planning to run advertisements.

Do I need to pay royalties?
This is probably a stupid question but I'm confused with all the copyright stuff, so any help would be appreciated.

the general rule is if in doubt then it's probably a yes.

it's something you'd really need to find out from the appropriate Germany licensing authorities if that's where the stream is essentially based.
