2 Dutch ISP are forced to block the Piratebay

Today, the Dutch civil court of The Hague ruled the Internet Service Providers (ISPs) Ziggo and XS4ALL are obliged to block the access to the website of the torrent site The Pirate Bay.

The Dutch anti-piracy foundation BREIN demanded the ISP’s to block access to The Pirate Bay, as the ISPs offer internet access which is used by subscribers to exchange copyright protected works through the torrent site, without consent of the right holders and therefore infringe copyrights and neighbouring rights. The court agrees and states BREIN has proven around 30% of the Ziggo subscribers and 4,5% of the XS4ALL subscribers have recently file shared music, films or games via The Pirate Bay (recital 4.13). Because of the so-called BitTorrent protocol that has been used, the court concludes these subscribers have not only downloaded but also uploaded these files and therefore infringed copyrights (as only uploading is illegal in the Netherlands). I don't see how a search engine is to blame for people who are uploading stuff, but the judge saw it differently I think.
But I heard on the news they also paid people to put illegal stuff online too.

In short: we're fucked.

With the firefox plugin that will get you around blocked sites, I don't see the point. There isn't really an effective way to firewall anything without deep packet inspection.

True, this doesn't stop anything and there are of course proxies too.
But the fact that a judge agreed to this is what made it newsworthy to me. What's the next step and where does this lead to?

Let's call a spade a spade. Piratebay isn't just criminal, it's very criminal. It's likely organized crime criminal.

The trick here is to get rid of the criminals without wrecking the internet. I don't think I have a problem with Dutch courts blocking this particular site. I don't think that's a problem. It remains to be seen whether this sort of thing will get applied unjustly.

Making ISP's responsible for what their customers do is a problem. It's likely to result in unintended censorship. If you start punishing ISP's for the actions of their customers, ISP's are likely to become overly cautious about what they host.

A web that was applying "fair use" to copyrighted materials might not get hosting. Nothing forces an ISP to host anything.

It's funny. Everything I upload to Youtube seems to have an "owner" that wants to step forward and claim pictures of my dog.
